The drunk driver who tore through Sunnyside last summer killing Roger Hernandez pled guilty to second-degree assault on Feb. 4 and will be sentenced to five years in prison, according to the Queens District Attorney’s Office.
On July 18, Alex Batista, 25, drove up behind and hit Hernandez, 37, on Greenpoint Avenue and 39th Place at 10:45 p.m.and then fled the scene.
Officers arrived and pronounced Hernandez dead from massive head trauma. Fifteen minutes later police discovered Batista lying in the street next to a black Infiniti M35 sedan blocks away. Police say he was acting belligerent.
He has been held in jail in lieu of $300,000 bail since his arrest.
Batista faced 15 years in prison for manslaughter, but instead he pled guilty. He will be sentenced to five years in prison, as first reported by LIC Post. Batista will also be fined $1,000 and ordered to install an Ignition Interlock Device for three years on any vehicle he operates following his release from prison.
