Subway platform shooting was gang-related, cops say

Six rounds fired in apparent MS-13 killing caught on video

The man shot dead on the 7 train subway platform at 90 St-Elmhurst Ave in Jackson Heights on Sunday afternoon, in front of dozens of onlookers, was a member of the Latin American 18th Street gang, and his suspected killer is with MS-13, police announced Monday.

The alleged shooter is under arrest, and police are still seeking another man who was with him at the time of the crime, NYPD Chief of Detectives Dermot Shea told reporters Monday.

“I am happy to report that today we do have a person in custody regarding that shooting,” She said, in video posted online by CBS. “We believe we have the shooter in custody, in under 24 hours.”

He later added, “He is a gang member. He is in our criminal group database as an MS-13 member. He has been arrested before in New York City, and in fact he has been part of a criminal group gang case before in New York City.”

Police later announced that the alleged shooter is Ramiro Gutierrez, 26. They did not say where he lives, and neither did the Queens District Attorney's Office when it announced the charges against him. Those are second-degree murder, first-degree gang assault and second-degree criminal possession of a weapon.

According to police, an argument between the victim and two other men began on a Manhattan-bound train and spilled out onto the platform a little before 12:45 p.m.

Cell phone video posted to social media shows the three wrestling next to the stopped train, with one of the men also punching the victim while some straphangers try to pull them apart. The other man then pulls away and gets up, with what appears to be a silver gun visible in his hand. The victim tries to get up and reach for either the man or the weapon, and then is shot. Five more shots follow the first.

The video, posted by Twitter user Bidur Bista, shows the shooter wearing a gray jacket with one darker gray triangle on each side at the hem, a gray hood, dark pants and a patterned scarf.

The other man who had been fighting with the victim was wearing what appears to be a black vest over a gray hooded sweatshirt, along with a gray knitted hat, dark pants and white sneakers with black and red markings.

They were last seen running down 90th Street. The victim, Abel Mosso, 20, of East Elmhurst, was declared dead at the scene.

“At this time we believe he was struck multiple times in the face, causing his demise,” Shea said.

On Sunday, police had said they did not yet know the motive for the killing.

“There is nothing to lead us to believe it was a robbery at this point,” NYPD Chief of Transit Edward Delatorre told reporters, in video posted by WCBS News Radio 880. “It appears to be just a dispute or an altercation. We don’t know why it took place. … We’re looking at every possibility; we’re leaving no stone unturned.”

Delatorre said the victim was struck more than once and that police do not believe any shots were fired on the train. 

He asked other witnesses to provide police with any videos they may have.

“There were many witnesses on that train that saw this incident,” he said, “so we’re asking any riders that actually have video to please send that video up to us and call us at 1 (800) 577-TIPS and give us anything you have, including descriptions of the subjects and anything they may have heard on that train.”

The number Delatorre gave is for the NYPD’s Crime Stoppers hotline. People with information can also submit tips by logging onto nypdcrimestoppers.com, or by texting 274637 (CRIMES), then entering TIP577. Spanish speakers may call 1 (888) 57-PISTA (74782). All tips are strictly confidential.

Shea said police already had received an “incredible” amount of tips and information from the public, saying, “We want to thank the public for their cooperation with this terrible act.”

The location of the killing, just north of the Elmhurst border, is within the NYPD’s 115th Precinct and Transit District 20.
