A 14-year-old boy was charged Aug. 8 with sexually assaulting a 4-year-old girl at a McDonald’s in Jamaica.
The alleged assault occurred at 8:25 p.m. Aug. 6 inside a “tubular play structure” in the children’s play area of the fast-food joint at 181-25 Hillside Ave., the NYPD said.
Police had released a surveillance video of the suspect the next day along with a description in which his age was estimated to be 18 to 30. But when they announced his arrest, they said the suspect is 14. Due to his age, the Queens Chronicle declines to print an image from the surveillance video.
The teenager was charged with first-degree criminal sexual act, a class B felony, since the victim was less than 11 years old.
Criminal sexual act carries the same penalties as rape and is defined the same way, except that the victim is sodomized rather than penetrated vaginally. Queens Assemblywoman Aravella Simotas (D-Astoria) has sponsored a Rape is Rape bill to more bluntly state what criminal sexual act is and reflect equality among victims. But prosecutors say it would make convictions more difficult, and it did not pass the Senate.
