The Nassau County District Attorney’s Office has dropped the single charge brought against the man who was arrested on Aug. 9 following the death of a Ridgewood resident in a boating accident.

Janusz Sowa had the charge of operating a vessel under the influence of alcohol dropped on Aug. 22 by Judge Anthony Paradiso according to a statement issued by the office of District Attorney Kathleen Rice. The charge was dropped “at prosecutors’ request and in the interest of justice.”

Sowa, whom police described as homeless, had been with Stanislaw Nawrocki on Nawrocki’s 26-foot boat on Aug. 9, when Nawrocki fell out of the boat near Rockaway Inlet.

His body was recovered the next day.

The statement from Rice’s office said there is no evidence suggesting that Sowa was responsible for Nawrocki’s death based on preliminary autopsy reports.

It also said circumstances surrounding Sowa’s operation of the boat “did not merit continued criminal prosecution.”

Sowa, who had been held since Aug. 9, was released following the hearing.Man cleared
